Terms & Conditions — Peace of Mind Security

Last updated: [10-2-2025]

Welcome to peaceofmindsecurity.com (the “Site”), operated by [Company Legal Name] d/b/a Peace of Mind Security (“Peace of Mind Security,” “we,” “us,” “our”).
These Terms & Conditions (the “Terms”) govern your use of the Site and—when you purchase or receive quotes for our products and services—your customer relationship with us.

By accessing the Site, requesting a quote, placing an order, signing a proposal, or using our services, you agree to these Terms. If you do not agree, do not use the Site or our services.

1) Who we are & how to contact us

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

2) Scope of services

We design, sell, install, configure, and maintain security solutions (e.g., alarm systems, cameras, access control, monitoring, and related software/services). Services may be provided by us and/or qualified third-party partners (e.g., UL-listed central stations, equipment manufacturers, licensed contractors).

Quotes & Statements of Work (SOWs). Any proposal, invoice, order, or SOW we issue (each, an “Order”) includes details that supersede general descriptions here. If a conflict exists, the Order controls for that job.

3) Site use & content

  • License. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business purposes.
  • Prohibited uses. Do not misuse the Site (e.g., attempt to gain unauthorized access, interfere with operation, scrape, reverse engineer, or post unlawful content).
  • Intellectual property. All Site content, trademarks, and software are owned by us or our licensors. You may not copy, modify, or distribute without permission.
  • Third-party links/tools. The Site may link to third-party sites or use third-party tools. We are not responsible for their content or practices.

4) Quotes, pricing & payment

  • Quotes. Quotes are typically valid for 30 days unless noted otherwise and may change due to site conditions, permitting, supply costs, or customer changes.
  • Deposits. We may require a deposit to schedule work or order equipment. Deposits are applied to the final invoice.
  • Invoices & due date. Unless stated otherwise, invoices are due net 15 days from the invoice date.
  • Late amounts. Past-due balances may accrue a 1.5% monthly finance charge (or the maximum allowed by law) and reasonable collection costs, including attorneys’ fees.
  • Taxes & fees. Prices exclude applicable taxes, permit fees, and third-party charges (e.g., false alarm fees). You are responsible for such amounts.

5) Scheduling, access & site readiness

You agree to provide reasonable access to the premises (including power, internet, and any required building access) on scheduled dates. If the site is not ready or access is denied, we may charge for wasted trips or rescheduling.

6) Delivery, risk of loss & title

Title to equipment passes upon full payment. Risk of loss transfers on delivery to you or your site. Until paid in full, we may retain a security interest in installed equipment as permitted by law.

7) Changes & cancellations

Change requests must be in writing. We will confirm any price/time impact. Orders canceled after materials are purchased or work has begun may incur restocking and labor charges.

8) Customer responsibilities

  • Maintain appropriate power, internet, and network connectivity for devices and monitoring services.
  • Keep passwords and access credentials secure and up to date.
  • Obtain any permits, approvals, or landlord permissions required for installation.
  • Comply with any recording and notice laws applicable to audio/video surveillance at the premises.
  • Replace consumables (e.g., batteries) and keep equipment areas free of obstructions.

9) Monitoring services (if included)

If your Order includes professional monitoring:

  • Monitoring is provided by us and/or a third-party central station. You authorize the central station to receive signals and, per your configuration, attempt to verify alarms and/or dispatch responders.
  • Not an insurer. We are not an insurer of your property or personal safety. You should obtain insurance covering property damage, personal injury, and business interruption.
  • No guaranteed response. We do not control the response time or actions of emergency responders.
  • False alarms & fees. You are responsible for municipal registrations and any false alarm fines or permit fees.
  • Communications. Alarms/signals rely on communication paths (internet, cellular, etc.). These can fail due to outages, tampering, or environmental factors. Redundant paths are recommended.

10) Software & remote access

Some systems include cloud or mobile apps provided by third parties. Your use is subject to those providers’ licenses. We are not responsible for outages or changes made by third-party platforms.

11) Warranties

  • Workmanship. We warrant our installation for 1 year from completion against defects in workmanship. We will repair or re-perform warranted work at no charge during this period.
  • Equipment. Hardware is covered by the manufacturer’s warranty only; we will assist with warranty claims as a courtesy.
  • Exclusions. Warranties do not cover misuse, alterations by others, normal wear, acts of God, power surges, vandalism, network or ISP issues, or issues caused by third-party software/services.
  • Disclaimer. EXCEPT AS EXPRESSLY STATED, THE SITE, EQUIPMENT, AND SERVICES ARE PROVIDED “AS IS” WITHOUT OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SITE, EQUIPMENT, OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $1,000, WHICHEVER IS GREATER.
WE ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY.

Because security systems are deterrents and not guarantees, you agree that the pricing reflects this allocation of risk. If you desire greater protection, you can request a higher-liability rider for an additional fee (if available).

13) Indemnification

You agree to indemnify and hold harmless Peace of Mind Security and its personnel from claims, damages, and expenses arising from your misuse of the Site or services, violation of laws (including recording/notice laws), or breach of these Terms.

14) SMS/email communications

By providing contact information, you consent to receive service, appointment, and account communications via email/SMS. You can opt out of marketing messages at any time (service messages may still be required).

15) Reviews, submissions & feedback

If you submit reviews, comments, or feedback, you grant us a non-exclusive, royalty-free license to use and display them (with first name/initial and city, unless you ask us not to) for marketing and service improvement, subject to our Privacy Policy.

16) Force majeure

We are not liable for delays or failures beyond our reasonable control (e.g., extreme weather, supply shortages, labor actions, utility/ISP outages, government actions, pandemics).

17) Dispute resolution; governing law

These Terms are governed by the laws of [Your State], without regard to conflict-of-laws rules.

Informal resolution. Most issues can be resolved quickly. Please contact us first.
Arbitration (optional clause—use if you want it): Except for small-claims matters, any dispute will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association. No class actions. You may opt out of arbitration within 30 days of accepting these Terms by emailing [legal@peaceofmindsecurity.com].

18) Termination & suspension

We may suspend or terminate Site access or services if you breach these Terms, fail to pay, or present safety/security risks. You remain responsible for amounts due and equipment in your possession.

19) Changes to the Site or Terms

We may update the Site, services, and these Terms from time to time. The Last updated date indicates when changes were made. Material changes will apply prospectively and be posted on this page.

20) Miscellaneous

  • Entire agreement. These Terms, the Privacy Policy, and any applicable Orders/SOWs constitute the entire agreement between you and us.
  • Severability. If any provision is unenforceable, the remainder remains in effect.
  • Assignment. You may not assign your rights without our consent; we may assign to an affiliate or in connection with a merger or sale.
  • Notices. Legal notices must be sent to the address in Section 1 (with a copy by email).
